Can you fly with CBD oil?

In most cases, you can bring your HempMeds CBD hemp oil products with you when you travel, especially when flying in the U.S.

But can you fly with CBD oil? When traveling within the U.S., the answer is yes! The TSA allows flyers to bring their CBD with them on flights. Before jetting off with your CBD, there are a few considerations you should be aware of. Here’s what you need to know about taking CBD oil with you on a plane.

Flying with CBD oil

Flying with hemp derived CBD oil is legally permitted under federal law, provided the product meets the Transportation Security Administration (TSA) rules around container sizes of liquids and gels.

Derived from hemp plants, HempMeds full-spectrum CBD oil products are legal under federal law, even if containing trace amounts of THC. In the United States, all hemp and hemp-derived products are legal.

The Transportation Security Administration or TSA has language in its “What Can I Bring?” section of its website that specifically allows for products containing hemp derived CBD, and FDA approved medications containing CBD, in both carry-on and checked luggage. This is the policy that answers any concerns you may have about flying domestically with CBD oil products.

According to the official TSA regulations website, “Products/medications that contain hemp-derived CBD or are approved by the FDA are legal as long as it is produced within the regulations defined by the law under the Agriculture Improvement Act 2018”, confirming that CBD oil can be brought on a plane next time you fly.

This language reveals that all hemp derived products are allowed through TSA checkpoints and on planes. The TSA adjusted its policy to allow CBD products from hemp due to the passing of the 2018 Farm Bill (Agriculture Improvement Act 2018), which legalized commercial hemp products federally and removed hemp from the Controlled Substances Act.

As long as travelers have CBD in forms that adhere to the regulations in the 2018 Farm Bill, the TSA will now permit it on an airplane. This includes all HempMeds CBD products. You can fly with CBD oil products in either your checked luggage or your carry on bag. Just remember that the TSA limits the size liquid or gel you bring on your flight in a carry on.

Following TSA rules and requirements to fly with CBD

The TSA limits the size of toiletries that can be taken in carry on luggage to 3.4 oz or 100 ml bottles or smaller. When flying, you simply need to place your CBD hemp oil products in the same one quart zip-top bag as your other bath and beauty products. This limited size only excludes a small handful of HempMeds products.

When shopping for CBD products, be careful to only purchase those that are derived from hemp and not marijuana. While marijuana products might be legal in your own state, CBD products made with marijuana contain too high a level of THC to be taken on an airplane or to other states.

“Possession of marijuana and certain cannabis infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law,” the TSA’s policy warns. “TSA officers are required to report any suspected violations of law, including possession of marijuana and certain cannabis infused products.”

The hemp derived CBD products in our store are exempt from this section of the TSA’s policy because they are made with low THC hemp. Be sure to purchase your CBD products from a trusted source, so you can be confident that they fit all federal laws and TSA policies.

While it is the TSA’s policy to focus on air safety issues and not actively search for cannabis, they can stop you from attempting to travel with other forms of cannabis containing high levels of THC.   • Only fly with hemp-derived CBD oil products. Not all CBD products are made from hemp. If you’ve obtained cannabis products elsewhere that are derived from marijuana, keep in mind that they will likely contain THC levels above the federal threshold. This includes most CBD products purchased from a medical or recreational marijuana dispensary. The TSA is a federal agency, which means federal laws apply in airports. If a TSA security officer observes marijuana products during security, they will refer the matter to a law enforcement officer.
  • Check your CBD product’s labels. Make sure that the label of your CBD product clearly signifies that it is made from hemp.
  • Pack your CBD product in the right bag. If your CBD product is 3.4 ounces (100 milliliters) or less, it can be stored in a quart-size resealable bag with your other liquid products like toiletries and carried on the plane. Store it in your carry-on where it’s easily accessible so you can take it out quickly when you go through security check. Any liquid CBD products that are more than 3.4 ounces need to go into a checked bag.
