We are in the middle of a transformative process in the way the government regulates hemp-derived CBD products. The U.S. Food and Drug Administration is utilizing the federal register to offer a “public and transparent way for stakeholders to provide new and emerging information.” And if you are interested in CBD, that stakeholder is you.

FDA is in the middle of crafting rules on how CBD can be marketed and sold and they want to hear what you think. The agency just recently re-opened a public comment page for people to give feedback about CBD and the impact it has made, particularly in the area of safe use. We feel there is no better time than now to make your voice count.

By taking advantage of this public commenting process and sharing your CBD story with FDA, you could play an integral part in defining what CBD is in our country. The agency is currently seeking scientific and experience-based accounts to help potentially revise its approach and preconceived idea on the benefits of hemp-derived CBD.

“As data become available that are high-quality, reliable and relevant to our evaluation of CBD products that fall under the FDA’s purview, we will be able to refine – and, perhaps in some cases, revise – our thinking and approaches,” FDA Commissioner Stephen M. Hahn recently explained.

FDA comments on CBD

Don’t want to put your business out there for everyone to see? FDA is offering a new option for those providing comments by opening a way for the public to provide confidential submissions. Using this path permits those submitting feedback an alternative to placing their personal information out there to be viewed by the public.

The comment period is open indefinitely and nearly 4,500 people have shared their stories so far.

Why Your Comments Are Important

FDA has the say on how hemp-derived CBD products will be regulated. Since the passage of the 2018 Farm Bill to verify the legalization of hemp and hemp-derived products in the U.S., CBD has exploded onto the market. However, with the change, many new products have hit the shelves without the evaluation of FDA.

If you have experience with CBD, we encourage you to share your story! Your comments to FDA may help influence the agency’s final decisions around manufacturing and testing standards, as well as guidance on the classification, labeling, quality, marketing, and sale of CBD-containing products.

FDA says it’s trying to move as fast as it can, but that the full development and implementation of rules will take an estimated two years.
